PCI Compliance:

BCS is committed to protecting consumer credit card data in compliance with the Payment Card Industry Data Security Standard (PCI DSS). Our alignment with this standard is reflected in the people, technologies and processes we employ.

We conduct regular vulnerability scans and penetration tests in accordance with the PCI DSS requirements for our business model. We attest to our PCI compliance annually, and our most recent self-attestation was completed in [September, 2021].

 

About BCS Digital Books (PDFs)

BCS Digital Standards - Digital PDFs are a single-user product with a license for personal use only. The digital PDFs are encrypted and require both the Acrobat plug-in and the FileOpen Acrobat plug-in.

All other BCS digital PDFs types only require Adobe Reader/Acrobat to view after download.

 

BCS (BuildingCodeStandards.com) maintains this site (the "Site") for your personal information, education and communication. Please feel free to browse through the Site. You may download material displayed on the Site for your personal use only, provided you also retain all copyright and other proprietary notices contained on the material. You may not, however, distribute, reproduce, modify, transmit, reuse, report, or use the content of the Site for public or commercial purposes, including the text, images, audio, and video without BCS express, prior written permission. Your access to and use of the Site is also subject to the following terms and conditions ("Terms and Conditions") and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms and Conditions.

You should assume that everything you see and read on the Site is copyrighted unless otherwise noted and may not be reproduced or used in any manner except as provided in these Terms and Conditions or in the text on the Site without the written permission of BCS. BCS neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with BCS.

 

 

    1. While BCS uses reasonable efforts to include accurate and up to date information on the Site, BCS makes no warranties or representations as to its accuracy. BCS assumes no liability or responsibility for any errors or omissions in the content of this Site.

You agree to indemnify, defend and hold harmless BCS, its affiliates, officers, directors, employees, consultants and agents from any and all third-party claims, liability, damages and/or costs (including, but not limited to, attorney fees) arising from your use of our services, your violation of our Terms of Services (including, but not limited to, a breach of your warranties and representations herein), or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. The Terms of Service will inure to the benefit of BCS successors, assigns, and licensees.

 

 

These Terms of Service will be governed by and construed in accordance with the laws of the State of TX, without giving effect to its conflicts of laws provision or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

 

Images of people or places displayed on the Site are either the property of, or used with permission by, BCS. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity and communication regulations and statutes.

 

The trademarks, logos and service marks (collectively the "Trademarks") displayed on the Site, including, but not limited to, the registered BCS mark and the BCS logo, are registered trademarks or trademarks of BCS. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of BCS or a third-party that may own such Trademark. Your misuse of any Trademark displayed on the Site, or any other content on the Site, except as provided in these terms and conditions, is strictly prohibited. You are also advised that BCS will aggressively enforce its intellectual property rights to the fullest extent of the law, including seeking of criminal prosecution.

 

BCS has not reviewed the external web sites linked to the Site and is not responsible for the content of any off-Site pages or any other web sites linked to the Site. By creating a link to a third-party web site, BCS does not endorse or recommend any products or services offered or information contained at that web site, nor is BCS liable for any failure of products or services offered or advertised at those sites. Such third-party may have a privacy policy different from that of BCS and the third-party website may provide less security than the Site.  Your use of links from the Site to reach other sites is at your own risk.

 

Any communication or materials you transmit to or through the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like are, and will be treated as, non-confidential and nonproprietary. Except as set forth in our Privacy Policy, anything that you transmit or post to or through the Site may be used by BCS for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting.

 

Furthermore, all information submitted to BCS through the Site shall be deemed and become the property of BCS, and BCS shall be free to use any ideas, concepts, know-how, or techniques sent to or through the Site for any purpose whatsoever including, but not limited to, developing, manufacturing, and marketing products using such information, without compensation or acknowledgment to you.

 

BCS may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions. A notification of claimed infringement must be in the form of a written communication provided to the agent that includes substantially the following:

    1. D) Information reasonably sufficient to permit BCS to contact the complaining party, such as an address, telephone number, and, if available, an e-mail address where the complaining party may be contacted;

 

 

    1. E) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner; and

 

 

    1. F) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is, or is authorized to act on behalf of, the owner of an exclusive right that is allegedly infringed.

 

 

RESPONSIBILITIES

You are responsible for maintaining the confidentiality of your account number and/or password and all other account numbers. You are responsible for all uses of your account, whether or not actually or expressly authorized by you.

 

Users alone are responsible for the contents of the messages they communicate when using our services and as well as the consequences of any such messages. You agree that you will not use our services for chain letters, junk mail, "spamming", or commercial solicitation or to engage in illegal activities. You represent and warrant that any material you post to or through the Site does not infringe or misappropriate any copyright, trademark, patent, publicity, privacy or other proprietary right of any person. You further agree not to use our services to send any messages or materials that are unlawful or that give rise to civil liability, including but not limited to defamatory, libelous or infringing materials or materials containing computer viruses, Trojan Horses or any other software code designed, intended or likely to cause damage to computer hardware, software or data of BCS or any third-party. You hereby consent to BCS accessing your account and records on a case-by-case basis to investigate complaints or other allegations or abuse. BCS will not disclose the existence or occurrence of such an investigation unless required by law. Violation of these terms may result in immediate deletion of a user's account.

 

Information posted to or entered into any message centers, message boards, forums or bulletin boards provided on this Site are public and not private communications. Although BCS reserves the right to remove without notice any such communications for any reason, BCS has no obligation to delete content that you may find objectionable or offensive.

 

BCS may modify or discontinue any services provided through this Site or your account, with or without notice, without liability to you, any other user or any third-party. The Floor Store the right to terminate your account if you have provided us with false or misleading registration information, interfered with other users or the administration of The Floor Store services or violated these Terms and Conditions.

 

Privacy Policy

 

This privacy policy describes how BCS and its affiliates ("BCS" or "we") process the personal information of our website visitors and customers. It also describes the cookies we may use and send to your computer or mobile device. Please note that this privacy policy is not an exclusive description of how BCS processes the personal information of individuals.

If you use BCS products or services, further information will be provided as part of the engagement process.

If you are an employee or worker of BCS, the information about how we handle your personal information as an employee is located on the BCS intranet and will have been notified to you. You can request a copy of the information from your HR representative.

If you are prospective employee or job applicant of BCS, we will provide you separately with information about how we handle your personal information for recruitment purposes.

Types of Data We Collect

We collect personal information directly from the individual to whom it relates, except where that individual has consented to BCS collecting the personal information from a third party or the law otherwise permits BCS to do so.

We may also share your personal information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, for audit purposes, or a violation of our policies.

 

    • Service Providers- We may share your personal information with service providers. Among other things service providers may help us to administer our website, conduct surveys, mail communications, or provide technical support, data center services or legal advice. You may, however, request that we delete your personal information. All requests must be directed to the contact in the "Contact Information" section below. When we delete personal information, it will be removed from our active database, but it may remain in archives where it is not practical or possible to delete it.     • Revocation of Consent- If you revoke your consent for the processing of personal information then we may no longer be able to provide you certain services. In some cases, we may limit or deny your request to revoke consent if the law permits or requires us to do so, if we are unable to adequately verify your identity, or if our processing is not based on your consent. Revocation of your consent will not affect the lawfulness of processing based on your previous consent.

 

    • Access to Your Personal information- To the extent required by law, upon request, we will grant access to personal information that we hold about you. All requests must be directed to the contact in the "Contact Information" section.

 

    • Online Tracking- We do not currently recognize automated browser signals regarding tracking mechanisms, which may include "Do Not Track" instructions.

 

    • Decline to Provide- You may choose not to provide some types of personal information to us. This choice may result in our websites or their functionality not working.

 

    • Object to Processing- You may, as permitted by law, request that we stop processing your personal information.

 

 How We Protect Personal Information

BCS is committed to:

    • taking reasonable steps to ensure that personal privacy is respected.

 

All our data is stored in written or electronic form on our servers and computers and in various physical locations. We maintain physical, electronic and procedural safeguards to protect your personal information from misuse, unauthorized access or disclosure and loss or corruption by computer viruses and other sources of harm. We restrict access to personal information to those staff members, joint venture partners, subsidiary companies and third parties who need to know that information for the purposes set out in this privacy policy.

However, no method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of any unauthorized access to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Our website permits you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

Retention of Personal Information

Your personal information will be retained for as long as it is necessary to carry out the purposes set out in this privacy policy (unless longer retention is required by the applicable law). However, we will not retain any of your personal information beyond this period and the retention of your personal information will be subject to periodic review. We may keep an anonymized form of your personal information, which will no longer refer to you, for statistical purposes without time limits, to the extent that we have a legitimate and lawful interest in doing so.

To process your data lawfully in the EU we need to rely on one or more valid legal grounds. The grounds we may rely upon include:

If you do not allow cookies, some features and functionality of our website may not operate as expected. We currently do not use cookies for advertising purposes.

We may use Adobe Flash technology (including Flash Local Stored Objects "Flash LSOs") that allow us to, among other things, serve you with more tailored information, facilitate your ongoing access to and use of the website, and collect and store information about your use of the website. Our website or emails may also use pixel tags, web beacons, clear GIFs, or other similar technologies to measure the success of marketing campaigns, and compile statistics about usage and response rates, and other purposes.     • Minors- Our websites are not for individuals under age 18. Those individuals should not access the website or provide personal information to us.

 

    • Transmission of Data to Other Countries- Your personal information is processed in the United States and may be transferred to other countries outside the EU, where privacy laws may be less stringent than the laws in your country and where the government, courts, or law enforcement may be able to access your information. In particular, your personal data may be transferred throughout the The Floor Store group and to our outsourced service providers located in the United States or abroad. By submitting your personal information to us you agree to the transfer, storage and processing of your information in the United States and other countries inside or outside the EU. We will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate technical, organization, contractual or other lawful means.     • Third Party Applications and Websites- We have no control over the privacy practices of websites or applications that we do not own, including websites to which our website provides hyperlinks.

 

    • Third Party Personal Information- Where you submit information on behalf of another person, you confirm that you have made that person aware of how we may collect, use and disclose their information, the reason you have provided it, how they can contact us, the terms of this policy and that they have consented to such collection, use and disclosure.
